("BERNARD JACKSON") is committed to respecting the privacy rights of our customers and all visitors to our web sites, web pages, interactive features, applications, blogs, social networks, and other online or wireless offerings, that post a link to this Privacy Policy (collectively, the “Site”). We have instituted this Site, Digital and Store Privacy Policy in order to explain our privacy practices and to describe the types of information we gather from individuals through (i) visits to and use of our website located at www.officialbernardjackson.com  (or any successor or similar digital properties such as an official app operated by us; or any other services that reference this Privacy Policy) (collectively, the “Site”), (ii) use of the wireless local area network provided to consumers at selected BERNARD JACKSON stores (the “Wi-Fi Service”), (iii) other services provided by us, including marketing or other channels described in or that refer to this Privacy Policy (individually or collectively, the “Service”), or (iv) our stores..

By accessing the Site or any other Service or by contributing any personal information in one of our stores, you agree to be bound by this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Site or any other Service.

Each time you visit the Site, the current version of the Privacy Policy will apply. You should check the date of the Privacy Policy (which appears above) and review any changes that have been made since your last visit to the Site. 

INFORMATION WE COLLECT

Information You Provide

You may provide information to us when you shop at our stores, purchase products from our Site or Service, register for an account or loyalty program, sign up for a newsletter, or communicate with us. Such information may include your name, email address, telephone number, other contact information, payment information, items purchased, return information, shipping and billing address, government-issued IDs (for verification purposes), and username and password.

Information that We Automatically Collect 

We, along with our third party service partners, may automatically collect information when you use the Site. The information collected includes, but is not limited to, device ID, device type, browser type and version, location information, computer and connection information, statistics on page views, traffic to and from the Site, ad data, IP address, referring website address, content viewed, interactions with content, and standard web log information. Location Information

If you use our mobile websites or install our mobile applications or other smart device applications, we may collect location data from your device, including when you are not using the device or application. Some of our device applications may use location information to detect whether you are near or in one of our stores. For many devices, you can control the sharing of device location via the settings menu or device portals.  

Other Information We Collect 

We collect information about you and your use of the Site from the PVH family of companies and from third parties like web hosting providers, analytics companies, social media platforms, data companies, and advertising services. The information we collect includes demographic information, information about your interests, and information about the devices you use to access the Site and other online services. You may use social media tools (e.g., like buttons, share buttons, or login features) on the Site. When you do so, we receive information from your social media account, such as your friends or contacts, profile picture, birthdate, gender, and other profile information that you share on the platform. The information we obtain from social media platforms depends on your account and privacy settings with the platforms and the platforms’ privacy policies. In our stores, we use technologies, including cameras, for security and fraud prevention in accordance with applicable laws.  

Social Listening

If you actively communicate about us or our brands on social media, we collect a copy of your communication. For example, if you use #BERNARDJACKSON in relation to one of our items we will retain a copy of the tweet and may use it for our brands awareness. In order to enable us to do so, we contracted a third parties for the provisioning of social listening services. Please note that any information you post or disclose through these services will become public and may be available to other users and the general public. 

Also, if you disclose any personal data relating to other people to us or to our service providers in connection, you represent that you have the authority to do so and to permit us to use the personal data in accordance with this privacy notice. If you choose to connect your social media account to your BERNARD JACKSON account (where such feature is available), you will share certain personal data from your social media account with us, for example, your name, email address, photo, list of social media contacts, and any other information that may be or you make accessible to us when you connect your social media account to your BERNARD JACKSON account. We will engage in these activities to manage our contractual relationship with you, with your consent or where we have a legitimate interest.

HOW WE USE INFORMATION

We use the information we collect for a variety of purposes, including:

    •    To process your transactions and provide you with the products and services you request

    •    To provide, maintain, protect, develop, and improve the Site and our services

    •    To improve your experience on the Site and in our stores

    •    For customer service, including to respond to your inquiries and requests

    •    To communicate with you about our and third-party products and services, in accordance with applicable laws and with your consent where required

    •    To analyze and learn about consumer trends and interests

    •    To learn about the devices you use to access the Site and other online services

    •    To personalize the content you see on the Site

    •    For administering contests, sweepstakes, and other promotions

    •    Maintaining your reward or loyalty program memberships

    •    To provide you with communications, recommendations, ads, and other information of interest to you, including via interest-based advertising based on your online activities on the Site and other online services (see the Use of Cookies section for more information)

    •    To prevent and detect fraud, criminal activity, and violations of our terms of use

    •    To protect our rights as well as yours and others

We use information that does not reasonably identify you for any purpose, including for statistical analysis of the Site.

Use of Cookies

Our Site uses cookies and similar tracking technologies to enable us to analyze how people use the Site; to improve and personalize your experience of our Site; to help us communicate with you about your account or the Site; to deliver direct marketing communications to you; and to serve advertising that, on some platforms, is tailored to you based on your browsing behavior and other information held about you.

This enables a website to recognize you as you move around the site and/or each time you revisit. Personalized Targeted Advertisement

Based on your on- and offline purchase history, your behavior on websites (visited pages, links clicked) and interaction with chatbot(s), we will set-up and maintain your personal digital marketing profile to make sure that we only show you advertisements that will most likely suit your personal taste. This is called targeted advertising. The more successful we are in targeted advertising, the higher our (prospective) customer satisfaction. To be able to show you targeted advertisements, we can also match your data profile with customers that have a similar profile. 

In order to support our targeted advertising we make use of a Data Management Platform (“DMP”). In the DMP information is collected on how our consumers respond to our products, brand and advertisements. This information is collected from different sources available to us offline, online and mobile, for instance when you are visiting our website. Next to that it is enriched with information collected by others, such as data relating to the local weather. Based on that information the DMP can help our marketing teams to find and define relevant segments of online audiences to direct marketing campaigns at to best reach them, within and beyond BERNARD JACKSON’s digital channels. If your digital marketing profile falls within such a segment you will probably receive our advertising tailored to the interests of the segment we placed you in on Facebook, Google properties, online properties of so-called affiliate parties and other online and offline locations and materials, which is targeted advertising. 

We may also use the data for retargeting by showing you a targeted advertisement on a third-party website that is linked to an event on our website, for example a specific purchase that was abandoned. 

In addition, Facebook, Google and other online actors can independently register your use of our advertisements. Please read the privacy policies of such third parties as we are not responsible for the personal data they process for their own purposes. 

Tracking Technologies: Web Beacons/Gifs, Pixels, Page Tags, Script

Web pages, emails and apps may contain small, transparent image files or lines of code that help record how you interact with the online services. These tracking technologies are often used in conjunction with cookies (or the unique identifier of your device), and they are used to help website and app publishers (including Shudder) to better analyze and improve their services and to target advertising based on your browsing behavior and interests. For example, we may use these technologies to learn about the web pages you visit or which elements of a page or application you viewed; when and for how long you interacted with our content; whether you viewed and/or clicked on an advertisement; and whether you opened or clicked on marketing communications that we may send to you. 

Tracking Via Mobile Applications and Other Applications

When you use our applications we may record unique identifiers associated with your device (such as the device ID and IP address), your activity within the applications, and your network location. We use cookies and tracking technologies for a variety of reasons, such as to enable us to recognize when you have logged in, to improve your experience of the Site, to learn about how users interact with and use the Site , to deliver advertising, and to remember your preferences. Some of the advertisements and marketing messages we send may be intended to reflect your interests as inferred by your activities on the Site and other online services a common practice known as interest-based advertising or behavioral advertising. Third parties may similarly use cookies and tracking technologies to deliver advertising and marketing messages relevant to you, which may be based on your online activities on various online services.

We list below the two main associations that represent the advertising networks allowed on our Site. You can visit their websites to opt out of all cookies served by their members and they will explain what happens as a result of opting out. In opting out, a cookie will be set to let advertisers know not to use your data for targeted advertising purposes; you will still see advertisements, they just won’t be tailored to your interests. If you clear your cookies via your browser, you will need to go through the opt-out process again.

You understand that these opt out mechanisms are maintained by third parties, not us, and we do not control the mechanisms of the third parties who choose to participate in these opt-out programs. 

SHARING INFORMATION WITH THIRD PARTIES

 Except as described in this Privacy Policy, BERNARD JACKSON will not rent or sell information that directly identifies you, without your consent, to unrelated third parties, for their direct marketing purposes or otherwise, except as stated in this Privacy Policy. We may share your information with our parent company and its affiliates.  

We (and our parent/affiliates) may share your information with our third-party service providers that provide assistance with operating or hosting the Site; providing or fulfilling the products and services you request; authorizing and processing of your payments; performing fraud protection and credit risk reduction, product customization, marketing and promotional material distribution, website evaluation, data analysis, Site improvements, and, where applicable, data cleansing, marketing, promotions and other services performed on our behalf or on behalf of our parent or affiliates. 

Some parts of the Site may contain embedded content controlled by third parties (e.g., social media) for services such as social sharing, commenting and displaying video or images. When you interact with these services, they may collect information from and about you and your interaction with their content, including the URL of the web page you are visiting. This activity will be subject to the privacy policy of and your settings for the third party network or service. Please be aware that they may track your activity, including through the use of cookies or similar technology, without you needing to interact with them. 

In addition, we may share or transfer information about you to unrelated third parties:

    -    when you engage in activities that are sponsored by third parties (e.g., cobranded offerings); 

    -    for online analytics purposes (e.g., with Google Analytics); 

    -     if required to do so by law or to comply with a legal requirement, judicial proceeding, court order, or legal process;

    -     to investigate a possible crime, such as fraud or identity theft; or 

    -    when we believe it is necessary to protect the rights, property, or safety of BERNARD JACKSON associates or other persons.

We may also share to the extent reasonably necessary to proceed with the consideration, negotiation, or completion of a merger, reorganization, or acquisition of our business, or a sale, liquidation, or transfer of some or all of our assets.   

We may use or share information that does not reasonably identify you with any third party and for any purpose.  

OPT OUT

You may withdraw your previously provided consent and elect not to receive marketing or promotional communications from BERNARD JACKSON. If you have established an account or signed up for our email list, you will have an opportunity to opt-out of receiving marketing or promotional emails or other such promotional communications from us by clicking on the Manage My Subscription link at the bottom of the email or by sending an email to thelist@officialbernardjackson.com.

Please note that removal of user information from our database or “opting-out” will not stop marketing or advertising content that is generated for distribution or is otherwise queued for transmission to you prior to the time when we can implement your request. Following receipt of a request from you, we will promptly refrain from sending you marketing or promotional communications within the timeframes required by applicable law.

If you establish an account, you may still receive certain types of communications even if you have not opted-in to receive them because these types of communications may be necessary in order to maintain an account on the Site. Please note that removal of user information from our database or “opting-out” will not cease any transactional emails related to your online order or any emails related to your loyalty program that we may send to you.

If your name, e-mail, postal address, telephone number or other contact information changes you can make changes via My Account. This Site may link from several points to third party websites. BERNARD JACKSON has no control over third party privacy policies, which may differ from this Privacy Policy. Please examine the privacy policies of such third parties prior to submitting any personal information. Neither BERNARD JACKSON nor its parent, affiliates, or service providers control the content that appears on any third party sites and do not endorse any of their products or services. Links to third party sites are provided solely for your convenience and any submission of data to such sites should be performed at your sole risk.

SITE NOT DIRECTED TO CHILDREN

BERNARD JACKSON is concerned about the safety of children when they use the Internet, and understands that children may not fully comprehend all of the provisions of our Privacy Policy or make informed decisions about the choices that are made available to adult users of the Site. We encourage parents and guardians to spend time with their children online and to be familiar with the sites their children visit. Our Site is not directed to children under the age of 13. If we become aware that a user is under the age of 13 and has registered without prior verifiable parental consent, we will remove his or her information from our files.
